Terms of Use

1. Introduction

These Terms of Use (the “Terms”) govern your access to and use of the ResiScore website at resiscore.co, along with all related pages, features, and services (collectively, the “Platform”). ResiScore is a community platform that allows renters to share and read reviews of landlords and rental properties. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not access or use the Platform.

2. Moderation

ResiScore reserves the right, but not the obligation, to monitor, review, remove, edit, or otherwise moderate any review or content posted on the Platform at its sole discretion, at any time, and without notice. ResiScore is not liable for any moderation decision, including any decision to remove, edit, retain, or decline to remove any content. The absence of moderation of any particular content does not constitute endorsement of that content.

3. Content and Conduct

You are solely responsible for any content you post, including reviews, ratings, and written text. All content you submit must be based on your genuine personal experience as a renter or tenant.

Prohibited content includes, without limitation:

• False, misleading, or defamatory statements;
• Hate speech or discriminatory content;
• Personal identifying information about landlords, such as personal phone numbers or home addresses;
• Threats, harassment, or intimidation;
• Promotional content, advertising, or spam;
• Off-topic content unrelated to a genuine rental experience.

By submitting content, you automatically grant ResiScore a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify, display, distribute, and otherwise exploit your submitted reviews and content in connection with operating and promoting the Platform.

4. Accounts

You may create and maintain only one account. You may not create fake accounts, create multiple accounts, or impersonate any other person or entity. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Prohibited Activities

You agree not to engage in any of the following: scraping, crawling, or harvesting data from the Platform; automated posting or use of bots; unauthorized collection of user or property data; or any attempt to gain unauthorized access to ResiScore systems, servers, or networks. You also agree not to interfere with or disrupt the integrity or performance of the Platform.

6. Indemnification

You agree to indemnify, defend, and hold harmlessResiScore and its owners, operators, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your posted content, your use of the Platform, or your violation of these Terms.

7. Disclaimers

The Platform is provided on an “as-is” and “as-available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. ResiScore does not guarantee the accuracy, completeness, or reliability of any user-submitted review or content.

8. Limitation of Liability

To the fullest extent permitted by law, ResiScore and its owners, operators, employees, agents, and representatives will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Platform or your reliance on any user-submitted content.

9. Section 230 Protection

ResiScore is a platform for user-generated content. Consistent with Section 230 of the Communications Decency Act, ResiScore is not the publisher or speaker of any review or content submitted by its users. Reviews reflect the views of the individual users who post them and not those of ResiScore.

10. Anonymity Disclaimer

While reviews are posted anonymously and ResiScore does not publicly display reviewer identities, ResiScore cannot guarantee that a landlord or other party will not identify a reviewer based on specific details included in a review (for example, a unit number, move-in dates, or a unique situation). You submit reviews at your own discretion and risk.

11. Dispute Resolution

In the event of any dispute, you agree to first attempt to resolve the matter informally by contacting ResiScore. If the dispute cannot be resolved informally, it will be settled by binding arbitration rather than in court, except where prohibited by law. These Terms and any dispute arising from them are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles.

12. Termination

ResiScore may suspend or terminate your account or access to the Platform at any time, at its sole discretion, including for any violation of these Terms, without notice or liability.

13. Changes to These Terms

ResiScore may update or modify these Terms at any time. Any changes are effective when posted. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
